Microsoft Copilot has been in the news this week after the discovery that its terms and conditions include the phrase, “Copilot is for entertainment purposes only.” This has caused no small amount of mirth among commentators, who note that Microsoft has pushed Copilot as a productivity solution.
Microsoft has since said that this language dates to an earlier, more casual Bing-centric AI experience, and will be removed in a forthcoming update. But given this surprising disclosure, and the fact that Microsoft has integrated Copilot throughout its online services, operating systems, Office suite, and mobile software, I thought it would be useful to share the Microsoft Copilot Terms & Conditions in full, in case there are any other surprises lurking.
MICROSOFT COPILOT TERMS & CONDITIONS
Definitions
Words like “we,” “us,” and “our” mean Microsoft, the company that offers Copilot, as well as the related companies we own or control and the companies and people that work on our behalf.
Words like “you,” “your,” and “yours,” mean you, the person we have tricked into using Copilot.
Code of Conduct
Don’t use Copilot to harm yourself or others. Don’t use Copilot to help harass, bully, abuse, threaten, or intimidate other people. Don’t use Copilot to help exploit others based on age, disability, or social or economic status. We already have that covered.
Don’t create or share inappropriate content or material. Don’t use Copilot to create adult content, violence or gore, or content that is otherwise disturbing or offensive. That includes the content you are thinking of right now. And that one. Also that one. Holy crap, go see a therapist.
Don’t do anything illegal. Let Copilot do that for you.
Important Disclosures & Warnings
Copilot is for entertainment purposes only. It can make mistakes, and it may not work as intended. Don’t rely on Copilot for important advice. Use Copilot at your own risk. No lifeguard on duty.
Copilot may include both automated and manual (human) processing of data. You shouldn’t share any information with Copilot that you don’t want us to post on a giant Teams group chat where we make fun of our customers.
Copilot may include advertising. Fuck it, we even put ads in Windows. Copilot WILL include advertising.
When you request that Copilot take actions on your behalf, you are solely responsible for those actions and any results or consequences. We cannot promise that any of Copilot’s responses will not infringe on others’ rights (like their copyright, trademarks, or rights of privacy). Frankly, we can pretty much guarantee that Copilot will infringe on others’ rights. It’s a large language model. Where do you think all of that training data came from?
You agree to indemnify us and hold us harmless (including our affiliates, employees, and any other agents) from and against any claims, losses, and expenses (including attorneys’ fees) arising from or relating to your use of Copilot when it infringes on intellectual property rights of others, defames others, provides content that is negligent or harmful, or commits petty larceny, wire fraud, vandalism, arson, and murder.
We may limit the speed or performance of Copilot as we think necessary. Because Jesus Christ, have you seen what these things cost to run? OpenAI has set like a hundred billion dollars on fire. Our shareholders are going to be PISSED if we keep giving you this much compute.
You may stop using Copilot at any time. In fact, we kind of hope you do, but forget to cancel your subscription.
That would be ideal.
Ownership of Content
We don’t own your content, but we may use your content to operate Copilot and improve it. By using Copilot, you grant us permission to use your content, which means we can copy, distribute, transmit, publicly display, publicly perform, edit, translate, and reformat it, and we can give those same rights to others who work on our behalf. We do not have to compensate, notify, or ask permission from you to do this. I mean, we didn’t ask the people whose content was used to train the model, why would we ask you?
Oh, and we’re definitely not granting you any rights to any of the underlying technology, intellectual property, or data that makes up Copilot.
Other Terms & Agreements
When you use Copilot, you are subject to the Microsoft Privacy Statement, which describes how we collect, use, and share information relating to your use of Copilot (i.e., extensively).
By agreeing to these terms, you are also agreeing that you’re an easy mark.
Copilot does not sleep. It waits.
